Disputes

Under English law an employer cannot dismiss an employee with more than one year's continuous service unless it is for a fair reason. If an employer fails to do so, then he is likely to face a claim for unfair dismissal. The maximum compensatory award for unfair dismissal is currently £63,000. Employees can also make claims for breach of contract, wrongful dismissal, race, sex and disability discrimination and many other breaches of statutory and contractual obligations. Employers can also take action against employees for breach of contract and in particular for breach of confidentiality obligations and restrictive covenants.
