If anything investments under the EIS are more complicated than those made by VCTs. The legislative basis of EIS goes back to the old BES schemes. Consequently the legislation includes a complicated patchwork of anti-avoidance provisions which arose as the Revenue shut the doors on a succession of asset backed, low risk or guaranteed exit investment products.
A detailed knowledge of these issues is crucial to ensuring that an investment under EIS has the best chance not just of obtaining tax relief but also of retaining it.
